PROPERTY REQUEST TERMS & CONDITION

You are entering into a legally binding agreement with 5-Star Listings when you agree to the terms below and fulfil the requisite conditions.

You and 5-Star Listings shall jointly be referred to as Parties and separately as Party. The following terms and conditions apply to this Agreement:

 

  1. Both Parties understand that you are interested in 5-Star Listings assisting you to search for a property (the “Property”) which you either want to rent or purchase (the “Search”).

  1. Both Parties understand that 5-Star Listing does not have any obligation to suggest to you the type, choice and location of the Property. You are expected to make your suggestions based on some certain requirement of your choice such as the market value of the property, location of the property, title to the property, and your budget (the Parameters).

  1. All these Parameters are subject to you to the exclusion of 5-Star Listings. 5-Star Listings is not obligated to advise you on any parameter.

  1. You are required to accept the terms of this Agreement and make a deposit of ₦1,000 (One Thousand Naira) to the account of 5-Star Listings (“Mobilization Fee”) before 5-Star Listings commences any search on your behalf.

  1. Both Parties understand that the Mobilization Fee shall be non-refundable. It is refundable on the condition that 5-Star Listings does not report on the status of the Search.

  1. Both Parties understand that upon the delivery of a search report, 5-Star Listings is not required and it is not mandated to provide you with choices that you like or deem fit; 5-Star Listings is only mandated and is required to provide you with a report based on the Parameters you have provided and subject to the availability of the Property.

  1. This Agreement is final, notwithstanding anything seen or heard anywhere else. This Agreement constitutes the final understanding of both Parties as it relates to only the Search of a Property by 5-Star Listings on your behalf.

  1. This Agreement is subject to the laws of the Federal Republic of Nigeria. Where there is any dispute, both Parties are obligated to first resolve it mutually, where this is not the case, mediation shall follow, before each party may refer to an Arbitration tribunal subject to the Arbitration Act LFN 2004. Litigation shall be a last resort.
